FCC Sets July 22 Vote on Modernizing U.S. Satellite Licensing Framework

The Federal Communications Commission is preparing to vote on a sweeping reform of the U.S. satellite licensing process on July 22, a move that could reshape how commercial and government space operators bring new systems online. The proposal, known as the Space Modernization Order, aims to replace decades‑old regulations with a streamlined framework designed to keep pace with increasingly large and complex satellite constellations.

A New Part 100 Framework to Replace Legacy Rules

Under the draft order, the FCC would retire its long‑standing Part 25 rules and introduce a new Part 100 framework. This update is intended to modernize license terms, processing rounds, surety bond requirements, and application procedures. The agency’s goal is to shift from bespoke, years‑long reviews to predictable timelines measured in months or weeks.

A key change includes shortening the public notice window for typical license applications from 30 days to 15 days, except when statute requires a longer period. Within 30 days of filing, the FCC would either place an application on public notice or notify the applicant of missing elements needed for completeness.

Creating a Licensing Assembly Line

The Space Modernization Order introduces what the FCC calls a licensing assembly line, a modularized process intended to accelerate approvals for next‑generation satellite systems. This approach is designed to support constellation operators who replenish and upgrade satellites frequently, often with evolving designs and new radio frequencies.

FCC Chairman Brendan Carr said the reforms are essential for maintaining U.S. leadership in the commercial space sector, noting that getting the regulatory framework right will determine whether the United States wins what he described as Space Race 2.0.

Addressing Congestion and Safety in Low Earth Orbit

As low Earth orbit becomes increasingly crowded, the order would require satellite operators to share tracking data with an approved space situational awareness provider. This measure is intended to reduce collision risks and improve transparency across operators. The FCC will also seek comment on establishing a space‑based experimental licensing regime to support emerging technologies.

Impact on Large Constellation Proposals

While the overhaul aims to accelerate most licensing reviews, pending applications for massive orbital data center constellations, including proposals for up to one million satellites, would not be subject to the revised timelines. These large‑scale concepts remain under separate consideration due to their unprecedented scale and complexity.

Broader Policy Context

The July 22 vote coincides with congressional consideration of the Satellite and Telecommunications Streamlining Act, which would impose statutory deadlines on the FCC’s licensing process. The FCC will also vote the same day on rules enabling an auction of 160 megahertz of upper C‑band spectrum, marking the agency’s first new commercial spectrum auction in five years.
